Labor Law 240/241

General liability for contractors, without the labor law exclusion

In New York, Labor Law 240 (the Scaffold Law) and 241(6) put responsibility for many job-site injuries on owners and contractors, especially falls and falling objects. Those claims can be large, so many carriers add a labor law exclusion to contractor general liability, or won't write New York construction at all.

A policy with that exclusion can look fine on a certificate and still leave you uncovered for the claim you're most likely to face. We place contractor GL that includes labor law coverage, with no labor law exclusion.

  • Labor Law 240/241 (Scaffold Law) claims covered, not excluded
  • No labor law exclusion for the GC or owner to find on your policy
  • Action-over and contractual liability reviewed against your contracts
  • Options from markets that write New York construction work

FAQ

NY contractor insurance and labor law questions

What is New York Labor Law 240/241?

It's the law that makes contractor insurance in New York so hard to get. If a worker is hurt on a New York job from a fall or a falling object (240, the Scaffold Law) or a safety-code violation (241), the owner and contractors can be held fully liable, even if the worker was partly at fault. These are some of the biggest lawsuits in New York construction.

What is a labor law exclusion?

Wording many carriers add to a contractor's general liability policy that takes away coverage for Labor Law 240/241 claims. If your policy has it, the lawsuit you're most likely to face on a New York job isn't covered. We place general liability for contractors with no labor law exclusion.

What is action-over coverage?

Your employee gets hurt on a job and collects workers comp from you. Then they sue the GC or building owner under Labor Law 240/241, and the GC or owner turns around and sues you to cover it, usually under the hold-harmless agreement in your contract. That claim back against you is the action-over. Many policies exclude it. You want a policy that covers it.

Why do New York contractors get declined?

Most carriers either won't write New York contractors or only write them with a labor law exclusion. Work at height, a new business, prior claims or a lot of subcontracted work makes it harder still. We have exclusive markets that write these contractors.

Do you insure every trade?

Yes. General contractors and subcontractors in every trade, including roofers, electricians, plumbers, HVAC, carpenters, masons, demolition, painters and renovation contractors.

What insurance does a general contractor need?

Usually general liability, workers comp, commercial auto and often an umbrella. Builder's risk is bought per project. Your contracts tell you exactly what's required, so send us those and we'll match them.

What do you need for a quote?

Your trades, payroll and revenue, how much you subcontract, your current policy and loss runs if you have them, and the insurance requirements from the jobs you're bidding. Send what you have and we'll take it from there.
